共享单车上树、违停……中心市区街头的共享单车不断增多，给市民带来便利之余，一些不文明现象也开始逐渐出现。近日，有市民拍下东湖街一辆哈罗单车挂在树上，文明借还车的话题再次引发关注。记者了解到，如果借车人给共享单车加装私锁，将会被扣光信用分，甚至可能被行政拘留。
目前，哈罗单车已投放3000多辆单车，3万多人通过APP完成注册，但一些不文明现象也在逐渐出现，比如单车被骑进小区停放或停放在公交站台前以及单车被挂上树等。
“目前泉州市民骑行总体情况良好，没有发现市民给共享单车私自加锁的现象。”哈罗单车泉州公司负责人王仕平介绍，如果出现私自加锁情况，用户将被扣光100分的信用分冻结账户，公司还将报警处理。泉州目前出现较多违反规定的情况是，用户将共享单车骑回小区内停放，这可能是有的用户对共享单车使用规则还不熟悉，王仕平介绍，哈罗单车APP内有详细规定，用户良好行为可加分，不当行为则会被减分，其中“违停一次(小区、地库、单位大院等扣20分，加装私锁、忘记关锁导致单车丢失等将扣至0分”。
泉州“小黄人”自行车属于有桩停放，市民需将小黄人停到固定桩位站点才算完成还车，较少出现乱停乱放现象，但也有车辆遭破坏或丢失的情况出现。“以前有市民空踩单车导致车辆毁坏等不文明现象，经过媒体曝光后，情况已大为好转。”微笑自行车公司主任郑美玲介绍，现在感觉市民对“小黄人”还是很爱护的，目前较多出现的不文明现象是限单人骑行的“小黄人”被两人骑，车篮经常被塞广告单，一下雨便烂成垃圾等。
前两天，有市民拍下在领袖天地路口，一辆停放的“小黄人”车轮毂断裂，郑美玲说，经调查，这辆“小黄人”是凌晨被人骑电动车撞坏的，肇事者疑似喝醉酒，肇事后离开现场，公司维修人员已将损坏的车辆载回维修。
近日，北京两名女护士下班时刚要打开被自己私自上了锁的共享单车，就被附近的民警抓个正着。两名女护士承认私自占用共享单车，两人最终因涉嫌盗窃被处以行政拘留5日。
北京律师张新年接受记者采访时表示，“违停，上私锁，藏匿，破坏二维码、车锁、定位装置等行为，除了需要向单车提供方承担民事责任，还涉嫌违法乃至犯罪。比如，乱停乱放涉嫌违反交通管理法律法规，私藏私用特定情形下涉嫌盗窃，破坏单车则涉嫌故意毁坏财物，有可能被行政处罚，甚至追究刑事责任。”特别是破坏单车二维码、车锁，上私锁等行为，使得单车脱离了监管，排除了其他用户使用的可能，很容易被认定为盗窃行为，依照《刑法》的规定构成犯罪的，依法追究刑事责任;尚不够刑事处罚的，由公安机关依照《治安管理处罚法》给予处罚。
